Petitioner is the Secretary of the Church Council of the India Evangelical Lutheran Church. According to the petitioner, election to the Trivandrum Synod of the church was held on 25th and 26th June 2007. Subsequently, the Synod executive which was held on July 2, 2007 has appointed respondent no.2 as the Manager of the Lutheran schools under the said synod for a period of three years with effect from July 2, 2007. It is also submitted that application for approval of appointment of respondent no.2 has been submitted before respondent no.1. The limited prayer is to issue a direction to respondent no.1 to take a decision on Ext.P4 application for approval.

Therefore, the writ petition is disposed of with a direction to respondent no.1 to consider and pass orders on Ext.P4 strictly on its merit and in accordance with law as expeditiously as possible, at any rate, within two months from W.P.(C)No.22057 OF 2007 the date of receipt of a copy of this judgment. Needless to mention, respondent no.1 shall ensure that apart from the petitioner, all other interested parties in the affairs of the Church Council and the administrators appointed by the High Court of Madras are afforded sufficient opportunity to be heard before any decision is taken. Petitioner shall produce a copy of the writ petition along with a certified copy of the judgment before respondent no.1 for compliance. Writ petition is disposed of as above.
