R.BASANT, J

Crl.M.C.No.2341 of 2007

Dated this the 23rd day of July, 2007

O R D E R

The petitioners were granted anticipatory bail as per order dated 02.05.07. The anticipatory bail was granted subject to conditions. The anticipatory bail order was to hold the field for a period of one month, within which period, the petitioners were to surrender before the learned Magistrate and seek regular bail. In obedience to the order dated 02.05.07, the petitioners did surrender before the learned Magistrate and were enlarged on regular bail, it is submitted. It is submitted at the Bar that the learned Magistrate has not imposed any condition while granting regular bail. If that be so, I fail to understand why the petitioners should continue to comply with the conditions imposed in the order dated 2.5.07. The order of anticipatory bail was to hold the field only for a period of one month. The conditions have to be complied with only during the said period of one month. If the Magistrate has imposed any condition at the time of grant of regular bail, the petitioners must move the learned Magistrate to modify those conditions imposed. The petitioners are not now obliged to comply with the conditions imposed in the order dated 02.05.07 passed by this Court. If the petitioners have not appeared before the learned Magistrate and secured regular bail, Crl.M.C.No.2341 of 2007 2 needless to say that the petitioners shall now be liable to be arrested by the police.

2. With the above observations, this Crl.M.C is, dismissed.
