W.P.(C)NO.23085 OF 2007

DATED THIS THE 27th DAY OF JULY, 2007

JUDGMENT

The petitioner passed B.Sc Nursing Course from Laxmi Memorial College of Nursing, Mangalore and obtained registration from the Karnataka State Nursing Council. There was a mistake in the date of birth of the petitioner in the school records, which is in Kerala. The petitioner got the same corrected in accordance with the procedure prescribed by the Government of Kerala and sought corresponding correction in the register of the Karnataka State Nursing Council as well as the registration certificate issued to the petitioner. The same was rejected by the 2nd respondent on the ground that the correction has not been in accordance with the procedure prescribed by the State of Karnataka, which requires a court order for such corrections. I have in a batch of writ petitions on the same subject held that in so far as school records in Kerala can be corrected in accordance with the procedure prescribed by the State of Kerala, the 2nd respondent cannot insist upon such correction in accordance with the procedure prescribed by the State of Karnataka. In the above circumstances, I allow this writ petition and direct the 2nd respondent to make appropriate corrections in the register W.P.(c)No.23085/07 2 maintained by the 2nd respondent as also the registration certificate issued to the petitioner. This shall be done within a period of one month from the date of receipt of a copy of this judgment.
