ORDERApplication for regular bail. The petitioners face allegations, inter alia under Section 323 and 308 read with 149 IPC. They are accused 5 and 6. Altogether there are 9 accused persons. The alleged incident took place on 6.7.07. The petitioners were arrested on the same day. They continue in custody from that date.
2. The learned counsel for the petitioners prays and the learned Public Prosecutor does not oppose the said prayer. The nature of injury has been narrated in detail with the help of the wound certificate to me and I am satisfied that the petitioners can be enlarged on bail subject to appropriate conditions.
3. In the result, this application is allowed. The petitioners
shall be released on bail on the
following terms and conditions:-
i) They shall execute bonds for Rs.25,000/-(Rupees twenty five thousand only) each with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate. B.A.No.4569 of 2007 2 ii) The petitioners shall make themselves available for interrogation before the Investigating Officer between 10 a.m. and 12 noon on all Mondays and Fridays for a period of two months and thereafter as and when directed by the Investigating Officer in writing to do so.
