W.P.(C).No. 16197 of 2007 Dated this the 27th day of July, 2007.

JUDGMENT

Raman, J.

First petitioner is the wife of the 2nd petitioner. Second petitioner is the younger brother of the 4th respondent herein. This writ petition was posted along with WP(C) No.15319 of 2007, as there is an allegation that, at the instance of 3rd respondent, Dy. Superintendent of Police, who is a close friend of 4th respondent, the petitioners and their children are being continuously harassed by the police. A similar averment is made in the other writ petition seeking necessary relief. We have already disposed of the said writ petition. What remains to be considered is only the prayer seeking a direction commanding respondents 1 and 2 to entrust the investigation of Crime No.64/07 and 65/07 of Perumpatty Police Station by an authority superior to the 3rd respondent, Dy. Superintendent of Police or by another agency like Crime Branch etc. As per the averments in the writ petition, the petitioners are not satisfied with the investigation conducted by the Perumpatty Police Station. It is not necessary to consider the prayer as such at this stage as the crime was investigated by the Perumpatty Police and a refer report has been filled before appropriate Magistrate. Since a report has already been filed, we close this matter subject to the rights of the petitioners to seek appropriate remedies as against the said report, if they are aggrieved.
