ORDER
Application for regular bail. The petitioner faces allegations, inter alia, under Secs.326 and 307 of the IPC. He is the 1st accused. The alleged incident took place on 21/3/07. The petitioner remains in custody from 21/6/07. An earlier application filed by the petitioner was dismissed as per the order dated 10/7/07 in B.A.No.4151/07 with the observation that the petitioner can move this Court for bail again at a later date - not prior to 24/7/07. Accordingly, this application has been filed. This order must be read in continuation of the earlier order dated 10/7/07 in which facts have been referred to in detail.2. The learned counsel for the petitioner prays, the learned Public Prosecutor does not seriously oppose the said prayer and I am satisfied that the petitioner can now be B.A. NO. 4631 of 2007 -: 2 :- enlarged on bail subject to appropriate terms and conditions.
3. In the result:
(a) The application is allowed.
(b) The petitioner shall be released on bail on the following
terms and conditions:
(i) The petitioner shall execute a bond for Rs.50,000/- with
two solvent sureties each for the like sum to the satisfaction
of
the learned Magistrate.
(ii) The petitioner shall make himself available for
interrogation
before the Investigating Officer on all Mondays for
a period of two months from this date.
(iii) The petitioner
shall not enter the Sessions Division of
Manjeri without the prior permission of the learned Magistrate
except
for the purpose of complying with Condition No.(ii) above.
