ORDERApplication for regular bail. The petitioner is accused No.2. He along with the 1st accused was arrested on 07.07.07. They along with other accused face allegations under the provisions of the Wild Life Protection Act. They were allegedly found to be in possession of leopard skins, fake as well as genuine. The petitioner moved the learned Sessions Judge for regular bail. The same was dismissed. He continues in custody. The co-accused (1st accused) made a second application for regular bail before the learned Sessions Judge and has been released on bail as per order dated 28.07.07, it is submitted.
2. The learned counsel for the petitioner prays, the learned Public Prosecutor does not oppose the said prayer and I am satisfied that the petitioner can now be enlarged on bail subject to appropriate terms and conditions.
3. In the result, this application is allowed. The petitioner
shall be released on bail on the following terms and
i) The petitioner shall execute a bond for Rs.1,00,000/- (Rupees One lakh only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate; B.A.No.4642 of 2007 2 ii) The petitioner shall make himself available for interrogation before the Investigating Officer between 10 a.m and 12 noon on all Mondays and Fridays for a period of three months from the date of his release or until final report is filed, whichever is earlier.
