Dated this the 3rd day of January, 2007
This writ petition is for a direction to release the vehicle bearing Reg. No. KL-01-AP-456, seized for forest offence. Since the adjudication proceedings have to be completed, the 1st respondent cannot release the vehicle unconditionally. However, there will be a direction to the 1st respondent to release the vehicle to the petitioner either on depositing the value of the vehicle in cash or by furnishing Bank Guarantee for its value from the local branch of a nationalized bank. If the petitioner is unable to get the vehicle released either by furnishing bank guarantee or by depositing cash for the value of the vehicle, there will be a direction to the 1st respondent to complete the adjudication proceedings, after hearing the petitioner, within a period of one month from the date of production of a copy of this judgment. Till then the 1st respondent is directed to keep the vehicle in good condition.
