W.P ( C) No. 23844 of 2007Dated this the 6th day of August, 2007
J U D G M E N T
The petitioner while working as Junior Superintendent at Sub Treasury, Pandalam was promoted as Sub Treasury Officer and transferred to Sub Treasury at Chadayamangalam in Kollam by Exhibit-P1 order. Thereafter, on request, he was transferred and posted to Pandalam by Exhibit-P2 order. The present complaint of the petitioner is that from Pandalam he has been transferred to Alakode Sub Treasury. It is stated that the transfer is illegal and there is no reason to transfer the petitioner. On instruction Government Pleader submits that though the petitioner joined the present station pursuant to Exhibit-P2, there were complaints against him from general public and it was therefore that he was shifted out of Pandalam. This court can interfere with the order of transfer, if the same is against any statutory provision or on grounds of malafides. In this case, neither of the grounds are made out. If there are complaints against the petitioner, the authorities are entitled to take necessary remedial action and if transfer is mode adopted, that is only in public interest and due to administrative exigencies. I see no reason to interfere with the impugned order. This writ petition lacks merit and it is dismissed.
