W.P.(C)No.24083 OF 2007

JUDGMENT

Petitioner is stated to be working as Higher Secondary School Teacher (Junior) in History in Bishop Hodges Higher Secondary School, Mavelikkara under the management of respondent no.2. Her grievance is that she is not being promoted as Higher Secondary School Teacher, though she is qualified and eligible for promotion. Petitioner has raised various contentions in support of her plea for a direction to respondent no.2 to promote her as Higher Secondary School Teacher (History).

2. But, I do not propose to deal with any of those contentions at this stage, in view of the limited prayer made by the learned counsel for the petitioner at the Bar. He submits that the petitioner has preferred Ext.P5 representation before respondent no.2 highlighting all the relevant aspects of the issue. The limited prayer is to issue a direction to respondent no.2 to take a decision on Ext.P5 expeditiously. W.P.(C)No.24083 OF 2007

3. In the above facts and circumstances, writ petition is disposed of with a direction to respondent No.2 to consider and pass orders on Ext.P5 strictly on its merit and in accordance with law as expeditiously as possible, at any rate, within two weeks from the date of receipt of a copy of this judgment. Respondent no.2 shall ensure that petitioner and all others who are likely to be affected by any order that may be passed by him are afforded sufficient opportunity to be heard before any decision is taken in the matter. Petitioner shall produce a copy of the writ petition along with a certified copy of the judgment before respondent no.2 for compliance. Writ petition is disposed of as above.
