Application for regular bail. The petitioner is the first accused. Altogether there are three accused persons. Accused 2 and 3 have already been enlarged on bail. The crux of the allegations is that the first accused who had negotiated with the de facto complainant for purchase of property had clandestinely obtained the original documents from the de facto complainant. He, practising fraud and impersonation, had got the property pledged with the bank with the help of accused 2 and 3 and had drawn amounts from the bank, misrepresenting the other accused to be the de facto complainant/his wife. The petitioner was arrested on 22/7/2007. He continues in custody from that date.2. The learned counsel for the petitioner prays, the learned Public Prosecutor does not oppose the said prayer and I am now satisfied that the petitioner who remains in custody from 22/7/2007 can now be enlarged on bail subject to appropriate conditions. 3. In the result, this petition is allowed. The petitioner
shall be released on bail on the following terms and conditions:
i) He shall execute a bond for Rs.50,000/- (Rupees fifty
thousand only) with two solvent sureties each for the like sum
to
the satisfaction of the learned Magistrate.
ii) The petitioner shall make himself available for
interrogation
before the investigating officer between 10 a.m
and 12 noon on all Mondays and Fridays, for a period of two
months and thereafter
as and when directed by the investigating
officer in writing to do so.
