ORDERApplication for regular bail. The petitioner faces allegations under the Wild Life Protection Act. The crux of the allegations is that when a vehicle was intercepted on prior information that the passengers were transporting snake poison therein, the petitioner was found available in the vehicle. He was intercepted. Another passenger of the car - a co-accused, allegedly ran away from the scene of the crime. No snake poison could be detected. It is assumed that the snake poison was taken away by the person who ran away from the spot of interception. The petitioner was taken into custody. He continues in custody from 30/7/07.
2. The learned counsel for the petitioner submits that there is not a shred of data to implicate the petitioner. The petitioner may, in these circumstances, be enlarged on bail, submits learned counsel for the petitioner. B.A. NO. 4971 of 2007 -: 2 :-
3. The learned Public Prosecutor does not oppose the said prayer. Appropriate conditions may be imposed on the petitioner, it is prayed. In the facts and circumstances of this case, I am satisfied that the petitioner can now be enlarged on bail subject to appropriate conditions.
4. In the result:
(a) The application is allowed.
(b) The petitioner shall be released on bail on the following terms and conditions:
(i) The petitioner shall execute a bond for Rs.50,000/- with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate. (ii) The petitioner shall make himself available for interrogation before the Investigating Officer on all Mondays and Fridays between 10 a.m. and 12 noon for a period of three months and thereafter as and when directed by the Investigating Officer in writing to do so.
