ORDERApplication for regular bail. This is the third application for regular bail filed by the petitioners who are accused 2 to 5 in the crime - one was dismissed as not pressed and the other was dismissed on merits as per order dated 29.06.07 in B.A.No.3948 of 2007. I have adverted to facts in detail in the said order. It is not hence necessary to advert to facts in detail in this order. The alleged incident took place on 21.05.07. Crime is registered, inter alia, under Section 398 I.P.C. The petitioners were arrested in some other crime on 21.05.07. Their arrest has been recorded in the present crime on 4.6.07. They continue in custody from that date.
2. The learned counsel for the petitioners prays, the learned Public Prosecutor does not oppose the said prayer and I am satisfied that the petitioners can now be enlarged on bail subject to appropriate terms and conditions.
3. In the result, this application is allowed. The petitioner
shall be released on bail on the following terms
i) The petitioners shall execute bonds for Rs.1,00,000/- (Rupees One lakh only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate; B.A.No.4975 of 2007 2 ii) The petitioners shall make themselves available for interrogation before the Investigating Officer between 10 a.m and 12 noon on all Mondays, Wednesdays and Fridays for a period of three months and thereafter as and when directed by the Investigating Officer in writing to do so; iii) They shall not leave the Sessions Division of Manjeri until further orders without the permission of the learned Magistrate.
