J U D G M E N T
Exts. P1 to P6 show that the petitioner has passed B.B.A. Degree examination through Distance Education Programme of the Mahatma Gandhi University. He sought admission to the M.B.A. course conducted by the respondent and had submitted an application. He was included in the rank list, but was informed that he was ineligible to be granted admission. In Ext. P8 the reason stated for declining admission is that the degree holders who have obtained degree through Distance Education Programme are ineligible in terms of the notification issued by the University.
2. The notification mentioned in Ext. P8 is Ext.
P1 in the writ petition. In Ext. P1 it is stated as
"Students who have passed the Qualifying Examination (prescribed under 'Eligibility Criteria') shall be eligible to apply for the CAT. (Degree obtained through Distance Education Programmes other than through IGNOU are not recognized by the Regulations of the WPC No. 25613/07 -2- University in force)." Therefore going by the terms of the notification only those who have obtained degree through Distance Education Programme IGNOU are eligible. Admittedly petitioner has obtained the degree from Mahatma Gandhi University and therefore is ineligible to seek admission to the M.B.A. course conducted by the respondent. In view of the above the contentions raised by the petitioner have no merit. Writ petition will stand dismissed. ANTONY DOMINIC
