O R D E RThese applications are filed by the petitioner, a woman for regular bail. In all the three cases, she faces allegations under the Kerala Abkari Act. The petitioner was allegedly found to be in possession of 5 litres, 2 litres and 3 litres of illicit arrack on 19/7/2007, 10/7/2007 and 12/6/2007 respectively. The petitioner surrendered before the learned Magistrate on 31/7/2007 and continues in custody from that date.
2. The learned counsel for the petitioner prays, the learned Public Prosecutor does not oppose the said prayer and I am satisfied that the petitioner, a woman who has remained in custody from 30/7/2007 can now be enlarged on bail subject to appropriate conditions.
3. In the result, these petitions are allowed. The petitioner can
now be enlarged on bail on the following terms and
i) She shall in each case executes bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate. ii) The petitioner shall make herself available for interrogation before the Aryancode excise range between 10 a.m and 12 noon on all Mondays for a period of one month and thereafter as and when directed by the investigating officer in writing to do so.
