J U D G M E N T

Petitioner is challenging installation of transformer in her property without her consent and without getting approval from the District Magistrate. According to the petitioner, though transformer is installed, it is not commissioned. In order to avoid delay, this writ petition is disposed of directing 2nd respondent himself to decide after inspection or get it decided by the ADM. Either 2nd respondent or ADM should conduct inspection in the presence of the KSEB officials and the petitioner and dispose of the matter. I make it clear that the minimum extent of petitioner's land only should be used, that too only if another suitable land causing lesser inconvenience to land owner/s is not located. If transformer can be located on road puramboke, 2nd respondent or ADM should approve the same. However, if installment of transformer in petitioner's property is inevitable, it should be done causing least inconvenience and petitioner should be granted compensation in accordance with law without any delay. The second respondent is directed to redress the grievance of the petitioner on production of a copy of WP(C) No. 26939/2007 this judgment by the petitioner. He will pass appropriate orders about shifting of transformer already installed. This writ petition is disposed of as above.
