ORDER

Application for regular bail. The petitioners are accused 3 to 5 and 7. They face allegations under Sec.489-B and C of the IPC. Their application for bail earlier was dismissed by this Court by order dated 4947/07. I had adverted to the facts in detail in that order. This order must be read in continuation of that order. It is unnecessary for me, in these circumstances, to refer to the facts in any greater detail in this order. Admittedly, no recovery has been effected from the petitioners. Accused 1 and 2 were allegedly found to keep in their possession counterfeit currency notes. Their interrogation had led the police to suspect the complicity of the petitioners.

2. The learned counsel for the petitioners prays, the learned Public Prosecutor does not oppose the said prayer and I am satisfied that the petitioners can now be enlarged on bail subject to appropriate terms and conditions. B.A. NO.5436 of 2007 -: 2 :-

3. In the result:

(a) The application is allowed.

(b) The petitioners shall be released on bail on the following terms and conditions:

(i) The petitioners shall execute bonds for Rs.1,00,000/- (Rupees one lakh only) each with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate. (ii) The petitioners shall make themselves available for interrogation before the Investigating Officer on all Mondays, Wednesdays and Fridays between 10 a.m. and 12 noon for a period of three months from this date. (iii) The petitioners shall not leave the Sessions Division of Kollam District until further orders without prior permission of the learned Magistrate.
