O R D E RPetitioner who is the accused in S.T.R.No.1622/2005 of J.F.C.M., Mahe for an offence punishable under Sec.138 of the Negotiable Instruments Act, 1881, seeks anticipatory bail.
2. Admittedly, consequent on the non-appearance of the petitioner before the trial court, non-bailable warrants of arrest have been issued against the petitioner. Anticipatory bail cannot be granted in a case like this so as to nullify the process issued by a court of competent jurisdiction. But, at the same time, I am inclined to grant the petitioner an opportunity to surrender before the concerned magistrate on 24.1.2007 to which date the case is said to have been posted so that he can seek regular bail from that court. Accordingly, if the petitioner surrenders before the magistrate at Mahe in the above case on 24.1.2007, he shall not be arrested in the meanwhile pursuant to the warrants of arrest issued by that court. The petitioner shall be free to seek regular bail from the magistrate by filing proper application on 24.1.2007. This application is disposed of as above.
