W.P.(C) NO. 27244 OF 2007
Dated this the 13th day of September, 2007
J U D G M E N T
Petitioner's vehicle bearing registration No.KL/10 P 3845 was seized under Ext.P1 mahazar on the allegation that it was involved in the unauthorised transportation of river sand. He complains that despite the seizure that took place on 8/9/07, there has not been any progress in the matter. On this basis, the petitioner seeks a direction to release the vehicle, pending adjudication. In the circumstances of the case, I do not think that the petitioner deserves an order for interim custody at this stage. Proceedings are to be finalised by the District Collector in terms of Rule 27.
2. I dispose of the writ petition directing the 3rd respondent to finalise the proceedings against the petitioner's vehicle, as expeditiously as possible, at any rate WPC 27244/07 within a period of two weeks from the date of receipt of a copy of this judgment.
3. Petitioner shall produce a copy of this judgment before the 3rd respondent for compliance. Writ petition is disposed of as above.
