O R D E RApplication for regular bail. The petitioner faces allegations under the Kerala Abkari Act. He was found to be in possession of 4100 packets of arrack each measuring 100 ml. Investigation is complete. Final report has already been filed. Cognizance has been taken. Committal proceedings has already been registered. The petitioner appeared before the learned Magistrate on 21/8/2007. He was remanded to custody. He continues in custody from that date.
2. The learned counsel for the petitioner prays, the learned Public Prosecutor does not oppose the said prayer and I am satisfied that the petitioner who continues in custody from 21/8/2007 in this crime in which investigation is already completed can now be enlarged on bail subject to appropriate conditions.
3. In the result, this petition is allowed. The petitioner shall
be released on bail on the following terms and conditions:
i) He shall execute a bond for Rs.1,00,000/- (Rupees one lakh only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate.
