B.A.No.5610 of 2007

Dated this the 19th day of September 2007

O R D E R

Application for regular bail. They were allegedly involved in the commission of theft of mobile phone using force. They face allegations under Section 392 read with 34 I.P.C. The alleged incident took place on 5/6/2007. The petitioners were arrested on 19/8/2007. They continue in custody from that date. The learned counsel for the petitioners submits that the petitioners, young persons who have remained in custody from 18/8/2007, may now be enlarged on bail.

2. The learned Public Prosecutor opposes the said prayer vehemently. The learned Public Prosecutor submits that the petitioners are involved in many similar crimes. They have allegedly committed such offence travelling together in a motor cycle and committing theft/robbery against unsuspecting persons. A group of bail applications filed by the petitioners have already been dismissed as per common order in B.A.No.5585 and connected cases on 18/9/2007. The petitioners B.A.No.5610/07 2 may not be granted bail in this case also, prays the learned Public Prosecutor.

3. I find merit in the objection raised by the learned Public Prosecutor. I am satisfied that this petition also deserves to be dismissed. Investigators in a serious crime like this must be given reasonable further time to complete the investigation, I am satisfied.

4. In the result, this petition is dismissed. However, I may hasten to observe that the petitioners shall be at liberty to move this court for bail again at later stages of the investigation not, at any rate, prior to 25/09/2007. The investigating officer shall, in the meantime, make every endeavour to complete the investigation.
