J U D G M E N T

The writ petitioner is a defaulter. He is before this Court, praying that an one time settlement may be extended to him. But, it is submitted that there is no such one time settlement scheme applicable to Urban Co-operative Banks. The counsel for the writ petitioner, therefore submits that, whatever benefits available, including the deduction in the rate of interest, penal interest and other such deductions, allowed by the Urban Co-operative Banks, may be granted.

2. In the above facts situation, I direct the writ petitioner to approach the first respondent, with a representation, in which event, the first respondent shall hear the writ petitioner and dispose of the same, granting the benefits that are available, as is prevalent, according to the provisions of the law. This shall be done within one month from the date of receipt of the representation. W.P.(C) No.18310/2005 (D) 2

3. There shall be no coercive steps against the writ petitioner, till a final decision is taken on the representation of the writ petitioner. The writ petition is closed as above. (J.M.JAMES) Judge ms
