The petitioner retired from service on 30.6.2005 while working as Upper Division Clerk in the Panchayat department. He has sought for a direction to the respondents to sanction and disburse the entire amounts due to him under the Kerala Panchayat Employees Provide Fund with interest, up to the date of payment.
2. During the hearing of this case, learned counsel for the petitioner submits that the petitioner has received the amount due under the provident fund and what remains to be considered by the respondents is the claim for interest for delayed payment. Recording the submission that the petitioner has got the main relief out of Court, I hold that that part of the relief has become infructuous. As far as the claim for interest is concerned, I think the petitioner will have to take up the same separately pointing out relevant facts and circumstances in that behalf. Representation shall be filed before the second respondent as early as possible. On receipt of such representation, the second respondent shall consider the same after notice to the petitioner and any other person who is interested or entitled to be heard in the matter. WPC 24847/2006 2 Final decision shall be taken within three months from the date of receipt of the representation of the petitioner. Writ petition is disposed of as above. K.K.DENESAN Judge jj
