JUDGMENT
The petitioner is working as Junior Superintendent in the District Collectorate, Thrissur. He appeared for the dpeartmental test in papers I and II of Kerala Criminal Judicial Test Part I for the year 2004 conducted by the Kerala Public Service Commission. When the result was published, it was found that he had failed to secure a pass. The petitioner made a request for rechecking. That request was considered by the respondent-Commission. After rechecking it was found that there was no error necessitating any correction. Thereafter the petitioner filed Ext.P2 representation requesting for revaluation of the answer script.

Counsel for the Commission submits that there is no provision compelling the Commission to conduct revaluation of the answer script and as a matter of long practice, the Commission has not been entertaining such applications. This Court as well as the apex Court has upheld the above stand taken by the Commission (See Maharashtra State Board of Secondary & Higher Secondary Education v. Paritosh Bhupesh Kurmarsheth (AIR 1984 SC 1543)). WPC 34220/2006 2
3. In the light of the settled legal position, the prayer made by the petitioner cannot be allowed. Writ petition is therefore dismissed. K.K.DENESAN Judge jj
