JUDGMENT

When the matter came up for consideration on 10.1.2007, it was noted that though the petition was filed on 25.11.2004, no steps had been taken so far, as ordered on 4.12.2006.

2. The counsel for the first respondent submits that owing to the order dated 26.11.2004, the first respondent, Kozhikode District Co-operative Bank Ltd, is not able to proceed to recover the amount, due from either the principal debtor or the guarantors. There was no representation from the counsel for the writ petitioner. Hence, the matter was posted for disposal on 17.1.2007. Thereafter, the matter was repeatedly posted to 19.1.2007 and further to 30.1.2007. There is a submission from the bar that the petition is not pressed. Hence, the writ petition is dismissed as not pressed. J.M.JAMES
