Petitioners who are accused Nos.1, 2 and 4 in Crime No.186/2004 of Pathanamthitta Police Station for an offence punishable under secs.143, 147, 148, 447, 341 and 308 read with sec.149 IPC, seek anticipatory bail.2. The case is now pending before the J.F.C.M.-I, Pathanamthitta, as C.P.No.7/2006. Admittedly, non-bailable warrants of arrest are pending against the petitioners. Anticipatory bail cannot be granted in a case like this so as to nullify the process issued by a court of competent jurisdiction. There is no reason why the petitioners should not surrender before the magistrate and seek regular bail. Accordingly, if the petitioners surrender before the magistrate and file applications for regular bail within two weeks from today, the same shall be considered and disposed of preferably on the same day on which they are filed, notwithstanding the warrants, if any, pending against them, after examining the explanation offered by the petitioners for their previous non-appearance. With the above observation this application is disposed of.
