O R D E RPetitioners who are accused Nos.6 and 7 in Crime No.231/2002 of Koipuram Police Station for offences punishable under secs.143, 147, 148, 323, 332 and 308 read with sec.149 IPC, seek anticipatory bail.
2. Consequent on the non-appearance of the petitioners before JFCM-II, Pathanamthitta, the case against them has been transferred to the long pending register where it has been registered as L.P.C.No.26/2004.. Admittedly, non- bailable warrants of arrest are pending against the petitioners. Anticipatory bail cannot be granted in a case like this so as to nullify the process issued by a court of competent jurisdiction. There is no reason why the petitioners should not surrender before the JFCM-II, Pathanamthitta, and seek regular bail. Accordingly, if the petitioners surrender before the magistrate and file applications for regular bail within two weeks from today, the same shall be considered and disposed of on merits preferably on the same day on which the applications are filed, notwithstanding the warrants, if any, pending against the petitioners. With the above observation this application is disposed of.
