O R D E RThe petitioner was directed to be released on bail as per order dated 01/01/2007 in B.A.No.7645 of 2006 subject interalia to the condition that the petitioner must himself make available before the investigating officer between 9 a.m and 11 a.m on all wednesdays. The learned counsel for the petitioner submits that the co-accused has already been released on bail without any such conditions. Chargesheet has already been filed also. In these circumstances, the condition that the petitioner must appear before the learned Magistrate on all dates of posting may be deleted, it is prayed. The learned Public Prosecutor does not oppose the said prayer. The petitioner's presence may be ensured before the investigating officer as and when directed, if necessary, it is prayed. I am satisfied that the request can be allowed.
2. In the result, this Criminal Miscellaneous Case is allowed. The condition that the petitioner must report before the investigating officer between 9 a.m and 11 a.m on all Crl.M.C.No.299/07 2 wednesdays is modified and it is directed that hereafter the petitioner need appear before the investigating officer as and when directed in writing by the investigating officer to do so.
