J U D G M E N T
The petitioner is a retired employee of the respondent. He has sought for a direction to the respondent to disburse the terminal benefits due to him including gratuity, arrears of D.A., amount due towards terminal surrender of earned leave, E.W.F., arrears on account of revision of D.A. etc.
2. It is not disputed that the petitioner is a retired employee and certain benefits are pending payment. However, counsel for the respondent submits that the payment could not be made on account of the bad financial position of the respondent.
3. Heard both sides. The above contention cannot be good reason for delaying payment inordinately. Hence, it is necessary that a time limit shall be fixed for payment of the amounts legitimately due to the petitioner. Accordingly, the writ petition is disposed of directing the respondent to disburse the terminal WPC No. 2611/2007 -2- benefits and other benefits due to be paid to the petitioner as early as possible, in any event, within four months from the date of receipt of a copy of the judgment.
