J U D G M E N T
This writ petition is filed under Article 226 of the Constitution of India directing the 2nd respondent to take immediate steps to recover the amount due to the petitioner under Ext.P1 award dt. 10.12.04 from 1st respondent-KSRTC. Motor Vehicles Act provides specific provision for execution of the award passed by the Motor Accidents Claims Tribunal. Hundreds of awards passed against first respondent are pending realisation. Petitioner cannot claim any special right to realise the award amount, when awards passed much earlier are pending due to the precarious financial condition of first respondent. In such circumstances, petitioner is not entitled to the reliefs sought for. Petitioner is at liberty to execute the award before the Motor Accidents Claims Tribunal. The writ petition is dismissed.
