O R D E RPetitioners seek anticipatory bail on the allegation that the Kumbla Police are at their heels in connection with Crime No.30/07 registered for offences punishable under sections 341, 323, 447 and 379 read with section 34 IPC.
2. Learned Public Prosecutor on instructions submitted that sections 447 and 379 IPC have since been deleted and that section 448 IPC has been added and that the surviving offences are all bailable offences. If so, invocation of section 438 Cr.P.C. is misconceived. This petition is disposed of without prejudice to the right of the petitioners to seek regular bail from the concerned Magistrate.
