O R D E RPetitioners who are accused Nos.1 and 2 in Crime No.12/2007 of Malappuram Police Station for an offence punishable under sec.20(b)(ii)(B) of the N.D.P.S. Act for allegedly having transported 5.850 kgs. of ganja in a car on 4.1.2007, seek their enlargement on bail. The petitioners were arrested on the same day.
2. The learned Public Prosecutor opposed the application.
3. The case of the prosecution is that on 4.1.2007 the police had intercepted a car parked on the side of the road to find 5.850 kgs. of ganja and the accused inside the car. 70% locomotor disability of the 1st petitioner cannot be a ground to release him on bail as I am not satisfied that both the grounds enumerated under sec.37(1)(b)(ii) of the N.D.P.S. Act are present in this case so as to justify the release of the petitioner. This Application is accordingly dismissed.
