PIUS C. KURIAKOSE, J.W.P.(C) No. 5512 OF 2007
Dated this the 20th day of February, 2007
The grievance of the petitioner is two fold. Firstly the amounts payable to him on account of Staff Welfare Fund has not been released and secondly the amounts due to him by way of increment, terminal leave surrender, pay fixation and leave salary arrears have not been paid. As regards the first one the petitioner is entitled for relief. But as regards the second one, it is for the K.S.R.T.C to take a decision. Accordingly, the Writ Petition will stand disposed of with the following directions: The respondents will release to the petitioner all the amounts due to him on account of his Staff Welfare Fund within two months of receiving a copy of this judgment. There will a further direction directing the respondents to take up Ext.P2, consider the same in the light of the various grounds raised in this Writ Petition and to take a correct decision on Ext.P2 at their earliest and at any rate within two months. It is needless to mention that if the decision comes to be in favour of the petitioner, the monetary benefits resulting will be released to the petitioner without further delay.
