O R D E RThe revision petitioner, who is the 4th accused in Crime No. 189/1995 and the sole accused in S.C. no. 97/2005, has sought for getting the records of the case returned to the trial court as the matter could not be disposed of on account of the summoning of records by this court for Crl. R.P. No. 2388/2006. The revision petitioner, it is submitted, was abroad during the trial of the above case and his case stands split up and refiled.
2. In the circumstances, it is ordered that the records of S.C No. 138/97/Crl. R.P. No. 2388/2006 is to be returned to Sub Court, Thalassery for the disposal of SC. No. 97/2005. The court below shall retransmit the records immediately after the disposal of S.C. No. 97/2005 The Crl. M.C. is disposed of accordingly.
