The petitioners, who are accused Nos.4 and 5 in Crime No.123/2007 of Karunagappally Police Station originally registered under section 41(1)(d) and 102 Cr.P.C. and subsequently registered for an offence punishable under Section 379 read with section 34 I.P.C., seek anticipatory bail.

2. The learned Public Prosecutor opposed the application.

3. The occurrence is the result of the rivalry between two cable TV operators by name Preetha Cable Vision and Aiswarya Cable Vision and the subject matter of the offence is the amplifier belonging to Aiswarya Cable Vision.

4. Anticipatory bail cannot be granted in a case of this nature. I am, however, inclined to permit the petitioners to surrender before the Investigating Officer for the purpose of interrogation and then to have their application for regular bail considered by the Magistrate having jurisdiction. Accordingly, the petitioners are directed to surrender before the Investigating Officer on any day between 26.2.2007 and 28.2.2007 for the purpose of interrogation and recovery of incriminating materials, if any. The petitioners shall, thereafter, be produced before the BA.939/07 Magistrate having jurisdiction on the same day. The Magistrate shall consider and dispose of the application, if any, filed by the petitioners for regular bail, preferably on the same date on which it is filed. This application is disposed of as above.
