JUDGMENT

The petitioner was working as Part-Time Casual Sweeper in ICDP Sub Centre, Muzhuppilangad in Kannur District. She continued to work from July 2000 till November 2005. It is contended that the sweeping area measured by the Engineers of PWD based on the revised orders is below 100 sq.metres. However, it is the submission of the learned counsel for the petitioner that having regard to the fact that the petitioner had been engaged from July 2000 onwards, she is entitled to seek for reinstatement in the light of G.O. dated 25.11.2005. It is submitted that there is a sanctioned post in the ICDP Sub Centre where the petitioner had been working. She has submitted Ext.P4 representation before the first respondent requesting to reinstate her in service.

2. Counsel for the petitioner submits that since the W.P.(C)No.6169/2007 :2: petitioner has been remaining unemployed, early orders on Ext.P4 is necessary to meet the ends of justice.

3. Heard the Government Pleader for the respondents.

Having regard to the facts stated above and having also regard to the request made by the petitioner in Ext.P4, the first respondent is directed to consider the request of the petitioner and dispose of Ext.P4, as expeditiously as possible, in any event, within two months from the date of receipt of a copy of the judgment. In case, the service of a Part Time Sweeper is required in ICDP Sub Centre, Muzhuppilangad in Kannur District, preference shall be given to the petitioner in the matter of appointment. This will be subject to the orders to be passed by the Government on Ext.P4. The petitioner shall produce a copy of the judgment and a copy of the writ petition before the first respondent for information and compliance.
