Dated this the 23rd day of February, 2007

O R D E R

Petitioner, who is the 4th accused in Crime No.907/2004 of Attingal Police Station for an offence punishable under section 489B IPC, seeks his enlargement on bail.

2. Learned Public Prosecutor opposed the application.

3. The case of the prosecution is that on 7.12.2004 four counter feit notes each of Rs.100/- denominations were seized from the 3rd accused, who is the husband of the first accused and subsequently a search of his house resulted in the recovery of 48 other counter feit notes of the same denomination. The confession said to have been made by accused Nos.1 to 3 is to the effect that the notes were handed over by the 4th accused to whom they were supplied by the 5th accused in the case. The petitioner was arrested only on 19.1.2007. The 5th accused is still absconding. The police are actively probing the case to find out the ramification of the racket behind the fake notes and the source of printing etc. If at this stage of the investigation the petitioner is released on bail, he will definitely influence or intimidate the prosecution witnesses and may also flee from justice. I am not inclined to grant bail to the petitioner. This application is accordingly dismissed.
