Petitioner, who is the common accused in C.C.Nos.1040 and 377 of 1998 on the file of the Additional Chief Judicial Magistrate, Ernakulam for an offence punishable under section 138 of the Negotiable Instruments Act, 1881, seeks anticipatory bail.

2. The petitioner is the Official Liquidator, High Court of Madras, Chennai. On 15.2.2007 this court had stayed the execution of the non-bailable warrants of arrest pending against the petitioner from the above court. Subsequently, the petitioner has produced an interim order dated 16.2.2007 from the High Court of Madras in Company Application No.283/2007 in Company Petition No.339/1999 dispensing with the personal appearance of the petitioner before the Additional Chief Judicial Magistrate, Ernakulam in the above cases and also staying all further proceedings in the above cases until transfer of the above proceedings to the High Court of Madras. In the light of the above order of the High Court of Madras, no orders on these applications are warranted. The appearance of the petitioner before the Additional Chief Judicial Magistrate, Ernakulam in the aforementioned C.C. cases will be subject to further orders which the High Court of BA.1052&1053/07 Madras at Chennai may pass in the matter. As long as he is exempted from appearing before the ACJM, Ernakulam by the High Court of Madras, the petitioner need not appear before the said court. These petitions are disposed of accordingly. A copy of this order shall be communicated to the Additional Chief Judicial Magistrate, Ernakulam.
