The Hon'ble MR. Justice PIUS C.KURIAKOSE
O R D E R
PIUS C.KURIAKOSE, J.R.P.NO.92/2007 IN W.P.(C) NO.3005/2005 Dated this 1st day of March, 2007
O R D E REven though Sri.M.K.Dileepkumar, the learned counsel for the petitioner, invited my attention to the judgment of this court, which lays down that for renewal of licence it will not be necessary to insist on the consent from the landlord and that the landlord's consent is necessary only at the time of issuance of the first licence, in view of the dispute on facts between the petitioner and the landlord, I am of the view that the issue should receive the attention of the Tribunal, the final fact finding authority under the statutory scheme. Accordingly, I dispose of the Review Petition without granting reliefs, however, making it clear that the interim order dated 25.1.2007 will continue for another six weeks from today. If the Tribunal for the Local Self Government Institutions receives appeal from the petitioner within three weeks from today, the R.P. No.92/2007 2 Tribunal will entertain the appeal as one filed on time and dispose of the same in accordance with law. PIUS C.KURIAKOSE Judge dpk
