O R D E RThe revision petitioner stands convicted for the offence under section 138 of the Negotiable Instruments Act and sentenced, as modified by the appellate court, to undergo simple imprisonment for one month and to pay an amount of Rs.1,00,000/- as compensation under section 357(3) Cr.P.C to the complainant and in default to undergo simple imprisonment for one month.
2. The counsel for the revision petitioner has sought for modification of sentence and for time to make the payment. In the circumstances, the sentence is modified to imprisonment till rising of the court and to pay the amount of compensation as ordered by the court below. The revision petitioner is granted six months time from today onwards to make the payment. The revision petitioner shall appear before Judicial First Class Magistrate-I, Aluva on 30.08.2007. NBW if any pending shall be kept in abeyance till then. The Crl. R.P is disposed of accordingly.
