Petitioner, who is the accused in C.R.No.6/2005 of Mannarkkad Excise Range for an offence punishable under section 55 (a) of the Abkari Act for having been found in possession of 4 litres of illicit arrack on 10.5.2005, seeks anticipatory bail.

2. Learned Public Prosecutor opposed the application.

3. This is the second application for anticipatory bail filed by the petitioner. This court had as per Annexure-1 order dated 7.7.2005 in B.A.No.4154/05 dismissed the application for anticipatory bail filed by the petitioner. This is nothing but a clear abuse of the process of this court. I see no ground to grant anticipatory bail to the petitioner. This petition is accordingly dismissed.
