O R D E RThe petitioner, a woman, is one of the accused persons facing indictment in a prosecution interalia under Section 395 I.P.C. The allegations against her are indeed grave. She was enlarged on bail as per order dated 15/09/2006 subject to conditions interalia that she must report before the investigating officer on every Thursday for a period of six months and that thereafter she must report before the investigating officer on the first working day of every month.
2. The learned counsel for the petitioner submits that the condition has been in force for a sufficiently long period of time and it is unnecessary and harsh to insist on complying with such conditions by the petitioner, a woman, any longer. The learned counsel for the petitioner submits that the petitioner shall make herself available for interrogation as and when directed by the investigating officer in writing to do so. 3. The learned Public Prosecutor does not seriously oppose the prayer and I am satisfied in the facts and circumstances of this case that the condition can be modified, as prayed for.
4. In the result, this petition is allowed in part. Condition (b) imposed on the petitioner shall stand modified and the petitioner need now report before the investigating officer only as and when directed by the investigating officer in writing to do so.
