IN THE HIGH COURT OF KERALA AT ERNAKULAMWP(C) No. 3168 of 2007(B)
1. C.M.BABY, AGED 52 YEARS,
1. STATE OF KERALA, REP. BY
2. THE S.I. OF POLICE,
3. THE SUPERINTENDENT OF POLICE,
For Petitioner :SRI.KRISHNADAS P. NAIR
For Respondent :GOVERNMENT PLEADER
The Hon'ble MR. Justice R.BASANT
O R D E R
R. BASANT, J.W.P.(C) NO. 3168 OF 2007-B
Dated this the 12th day of March, 2007
The petitioner complains about the inadequate investigation into the death of one Sanil aged 28 years. In respect of such death, Crime No.240/06 was registered on 9/7/06 at the Pazhayannur Police Station under the caption "suspicious death". Investigation is in progress. The investigation so far has led the police to the conclusion that the offence of murder has been committed. Accordingly, the said Section has been included and the investigation is in progress.
2. The statement filed by the Circle Inspector of Police suggests to the court that meaningful investigation is going on and that changing of the Investigating Officer at this stage would only retard the progress of the investigation. I am satisfied, in these circumstances, that no further directions need be issued at this stage. But I make it clear that I expect the Investigating Officer to continue the investigation in all W.P.(C) NO. 3168 OF 2007-B -: 2 :- seriousness and efficiency and complete the same expeditiously.
3. This writ petition is, in these circumstances, dismissed. But I make it clear that the petitioner's option to approach this Court again shall remain unfettered - but only after a period of three months from this date within which I expect the Investigating Officer to resolve the mystery of the crime.
