O R D E RThe petitioner seeks anticipatory bail on the allegation that Erumeli police are at his heels in connection with some crimes registered against him for having committed the non bailable offence.
2. The learned Public Prosecutor, on instructions, submitted that the petitioner is the sixth accused in Crime No.38/2007 of Erumeli Police Station for offences punishable under Sections 143, 144, 147, 324 and 308 IPC read with Section 149 IPC. He also submitted that the person who inflicted injuries was the first accused who was wielding an iron rod.
3. Anticipatory bail cannot be granted in a case of this nature. But at the same time, I am inclined to permit the petitioner to surrender before the Investigating Officer and then to have his application for regular bail ordered by the Magistrate concerned. Accordingly, the petitioner shall B.A.1474/2007 2 surrender before the Investigating Officer on any day between 19.3.2007 and 21.3.2007 for the purpose of interrogation. Thereafter, the petitioner shall be produced on the same day before the Magistrate having jurisdiction, who shall release the petitioner on bail on appropriate conditions.
