The petitioner is working as First Grade Draftsman (higher grade) in the second respondent Board. He has filed Ext.P5 representation before the very same authority. The grievance of the petitioner pertains to the delay in considering his claim for promotion to the post of Assistant Engineer (Civil). Counsel for the petitioner submits that if orders are passed on Ext.P5, the petitioner is likely to be promoted under the old rules and if Ext.P7 is considered on merits, he will be eligible to be considered for promotion to the post of Assistant Engineer (Civil) under the rules.
2. I have heard the standing counsel for the respondents and the Government Pleader for the first respondent.
3. There shall be an order directing the second respondent to consider Exts.P5 and P7, take appropriate decision and W.P.(C)No.8771/2007 :2: communicate the same to the petitioner within one month from the date of receipt of a copy of the judgment.
