J U D G M E N T

The primary prayer in this original petition is to issue a writ of mandamus to declare that the petitioner is entitled to get promotion to the category of Assistant Professor of Chemical Engineering in the vacancy that arose on July 14, 1998 in preference to respondents 4 and 5. Petitioner has a grievance that respondents 4 and 5 were preferred to him and they were promoted to the post of Assistant Professor on October 15, 1993. overlooking the eligibility of the petitioner. Petitioner has also prayed for issuance of a writ of certiorari to quash Exts. P11, P12 and P13.

I do not propose to refer to the various contentions raised by the parties in this original petition at this stage since it is submitted by learned counsel for the petitioner that the petitioner will be satisfied if an appropriate direction is issued to the management to consider the claim of the petitioner vis-a-vis respondents 4 and 5 expeditiously. It is brought to my notice that the management is in fact in the process of considering the claims of other similarly placed teachers in respect of various posts in other Departments including the post involved in this case also in view of the directions issued by this Court in W.P.C. No. 11628/05. Learned counsel for the management submits that the claim of the petitioner and respondents 4 and 5 will also be considered in the light of the directions contained in the judgment mentioned supra. In that view of the matter this original petition is disposed of with a direction to the 3rd respondent to take a decision on the claim made by the petitioner vis-a-vis that of respondents 4 and 5 in the light of the directions contained in the judgment in W.P.C. No. 11628/05 expeditiously.
