K.BALAKRISHNAN NAIR, J.W.P.(C) No. 9185 of 2007
Dated this the 19th day of March, 2007.
The petitioner has been granted a regular permit on the route Mathamangalam-Ambalapara-Korome-Kaleeswaram. It is valid from 16.12.2006 to 15.12.2011. It appears, the permit was issued to him on 31.1.2007. Feeling aggrieved by the time schedule granted to the said service, petitioner has preferred Ext.P2 representation dated 1.2.2007. Thereafter this writ petition is filed praying for a direction to modify the said time schedule. The time schedule was finalised only about one month back in a timing conference after taking into account the views of the other operators also. The same cannot be modified by the Secretary either suo motu or on an application within one month. Therefore, Ext.P2 is not maintainable. If the petitioner is aggrieved by the time schedule, he may file a revision against it before the State Transport Appellate Tribunal. Subject to that right, this writ petition is dismissed without prejudice to the contentions of the petitioner. K.BALAKRISHNAN NAIR, Judge. vns.
