O R D E RRevision petitioner stands convicted for the offence under Section 138 of the Negotiable Instruments Act and sentenced, as modified by the appellate court, to undergo simple imprisonment for one month and to pay a fine of Rs.16,000/- and in default, to undergo simple imprisonment for two months and that if the fine amount is realised, Rs.15,000/- is to be paid to PW1.
2. The counsel for the revision petitioner has only sought for modification of the sentence. In the circumstances, sentence is modified to imprisonment till the rising of the court. The rest of the portion of the sentence is affirmed. The revision petitioner shall appear before the Judicial First Class Magistrate Court, Vadakara on 24.4.2007 to receive the sentence.
