O R D E RThe revision petitioner stands convicted for the offence under Sec. 138 of the Negotiable Instruments Act and sentenced, as modified by the appellate court, to undergo simple imprisonment till rising of the court and to pay a compensation of Rs. 1,30,000/- vide Sec. 357 (3) Cr.P.C. and in default to undergo simple imprisonment for two months.
2. The revision petitioner has only sought for time to pay the amount of compensation. In the circumstances, revision petitioner is granted six months time from today onwards to pay the amount of compensation. If any amount has been deposited in the civil proceedings with respect to the same cause of action, the petitioner will be entitled to adjust the same in the amount of compensation ordered to be paid. The revision petitioner shall appear before the Addl. Chief Judicial Magistrate Court, Thiruvananthapuram on 24/09/2007 to receive sentence. Non bailable warrant, if any, pending shall be kept in abeyance until 24/09/2007. The Criminal R.P. is disposed of accordingly.
