O R D E RThe revision petitioner stands convicted for the offence under Sec. 138 of the Negotiable Instruments Act and sentenced, as modified by the appellate court, to undergo imprisonment till the rising of the Court and to pay a compensation of Rs. 1,00,000/- to the complainant and in default to undergo simple imprisonment for three months.
2. The learned counsel for the writ petitioner only sought for time to pay the amount of compensation. It is submitted that his business has totally collapsed and prayed for time for payment of compensation till first week of November 2007. In the circumstance, time is granted to the revision petitioner to pay the amount of compensation to the complainant till 02/11/2007. The revision petitioner shall appear before the Judicial Magistrate of the First Class - II (Mobile), Kottayam on 03/11/2007 to receive sentence. Criminal proceedings shall be kept in abeyance till 03/11/2007. The Criminal R.P. is disposed of accordingly.
